Facts
P sued to recover for personal injuries sustained when he was bitten by a spider while unloading bananas from a truck. P was employed with Colonial Stores and had been unloading a shipment from D. P sued for negligence. P also sued for negligence per se under the Georgia Food Act. P appealed from a grant of summary judgment in favor of Fidelity (D) as to P's negligence per se claim. P appealed.
