Facts
Agnes Margaret Summersby died from an illegal operation. Several hours after a doctor said in her presence that she may die Agnes made a statement to sister Gertrude. She described how the Defendant performed an abortion on her. At D’s trial, the statement was admitted as a dying declaration and D was convicted and appealed.
