Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

W and H were divorced in 1971 and W was awarded custody of the child and alimony of $75 per month with child support of $250 per month. In 1975, W sought an increase in child support to finance the child's college education. H filed for a reduction. The master increased H's child support to $480 of the $520 finding of need and terminated alimony payments. W appealed. The Court of Appeals found that the 92% support level of H to W for the child was clearly erroneous. The court did a strict mathematical split based on yearly income and determined that H was only liable for 5/8ths of the total sum or $325 and that W was liable for the rest. W appealed.
