Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

P filed this action against P asserting federal and pendent state-law claims of age, race, and sex discrimination and retaliation. P alleges she was denied a position as a sheriff's deputy with D, and that she was retaliated against on February 28, 1997, and thereafter, for complaining about discrimination. After P filed the complaint D obtained evidence that P had made misrepresentations on about her past employment. P seeks to exclude this evidence because it is inadmissible to show continuing retaliation for her complaints of discrimination in the sheriff's department's hiring process. P contends those records were not considered by D at the time it decided not to hire P. D also seeks to exclude evidence that it failed to dispatch an officer to assist P with a dispute that she had encountered at a store where she was working as a security guard. D contends that P’s difficulties in dealing with D after her rejection does not prove that she was a victim of discrimination.
