Facts

P leased property to Charles Miller for a rent of $1200 per year payable in monthly installments. Miller covenanted to pay rent and on the same day with written permission as was required by the lease, assigned the lease to D a corporation. D then assigned the lease to John Jones. P sued D to recover delinquent rent. Judgment went to D and P appealed.
