Facts

Jean Minnich (W) gave birth to Cory in 1983 and three weeks later filed a complaint for child support against Gregory Rivera (M) alleging that he was the father of Cory. M requested in advance of trial to rule that the statutory burden of proof of paternity violated Due Process and to instruct the jury that paternity must be proven by clear and convincing evidence. That motion was denied. M was found to be the father of the child. M was then granted a new trial. W appealed, and the Pennsylvania Supreme Court held the statute constitutional and reinstated the jury's verdict.
