Facts

Hartman (D) left his keys in his car so a garage attendant could take the car in for servicing. The relevant statute required an owner to take his keys out of his car when it is left unattended. D's car was stolen, and the thief hit Ross (P) with the car, injuring P. P sued to recover damages from D for the injury caused by D's violation of the statute. The trial court ruled for D. P appealed.
