Facts

Sedmak (P) entered into an oral contract with Charlie's Chevrolet (D) to buy a Corvette. It was one of a limited number of commemorative cars built as a Pace Car for the Indianapolis 500. P participated in a number of discussions and gave a deposit for the car, but the price was never agreed upon because D did not have all the full details regarding the car and P was the person who informed D that the car was to be produced. When the car was finally delivered to D, P was informed that they could not buy the car for the $15,000 manufacturer’s suggested retail price but would have to bid on it. The matter went to trial and the court found for P and ordered D to deliver the car. D appealed.
