Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Selders (P) sued Armentrouts (Ds) for the wrongful death of their three minor children. The court instructed the jury, 'except for medical and funeral expenses, the damages should be the monetary value of the contributions and services which the parents could reasonably have expected to receive from the children less the reasonable cost to the parents of supporting the children.' The jury found Ds negligent and returned a verdict against them for the exact amount of the medical and funeral expenses of the three children. Ps appealed.
