Facts

P sued D for the wrongful death of his 19-year-old son. An employee of D was in the process of installing a pole at the general store and filling station where P's son worked. That pole came into contact with a high voltage line, and P's son was electrocuted. P's son worked that the gas station. P got the verdict and D appealed on grounds that the deceased was subject to Workmen's Compensation.
