Facts
Slade (P) made a deal for his wheat and rye crops with Morley (D) for 16l. D agreed to buy a portion of the crops for the stated price. When P presented the grain to consummate the contract, D refused to buy. P brought this action on the case for nonpayment. D pleaded nonassumpsit modo et forma (did not undertake the promise and denies the other party's allegation in the exact form it was made).
