Facts

P sought discovery of D and D resisted discovery as he argued that since he was a French citizen that discovery could only be obtained pursuant to the Hague Convention. D moved for a protective order claiming that the Hague Convention governed discovery. The District Court denied discovery and the Eighth Circuit denied D’s writ of mandamus (D was the plaintiff in that writ).
