Facts

Brown (D) took a cleaning van as it was being unloaded. D took the van without permission and simply drove off after asking the workers to help then unload the dry-cleaning orders. D was almost immediately found in an alley notorious for having stolen vehicles dropped in it. When the police approached, D tried to flee but was unsuccessful. The van was recovered three blocks away. D was convicted of theft. D appealed contending that there was no proof of his intent to deprive the owner of the property and that the evidence was sufficient to convict only of joy riding.
