A restaurant was robbed by two males wearing ski masks and gloves while carrying a gun and knife, around midnight on Christmas Eve. An employee was shot by one of the robbers. A citizen relayed information to the police and they utilized a dog from a K-9 unit to track the scent along a trail through the woods and found money dropped at various places but they also found a ski mask. The scent trail ended at Wilson's residence. From DNA evidence found on a ski mask and gun, an executed search warrant, and a tip that Brown (D) confessed to committing the crime with Christopher Wilson-D and Wilson were arrested and charged with robbery, as well as other crimes stemming from the incident. Wilson was wearing a GPS ankle monitor at the time of the robbery. Wilson's GPS records showed that he was at the restaurant during the robbery. P presented Agent Powell's testimony to authenticate the GPS records. Powell testified that “It is very accurate. We use it in court all the time.” The evidence was admitted and D was found guilty and appealed. The court of appeals affirmed. D appealed.
