Facts
A statute stated that all trains must stop at crossings, and a failure to do so would result in a fine. Chicago, Milwaukee & St. Paul R.R. Co. (D), through its engineer, failed to stop at a crossing. The engineer had tried to stop the train but could not because the brakes were not working. D was required to pay the fine after a jury trial. D appealed.
