Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Komok (D), age 16, was convicted in Juvenile court for theft in the third degree for aiding and abetting his 14-year-old sister in taking a baseball cap, girls' stretch leggings, and a T-shirt that belonged to Lamont's department store. The sister took the merchandise from the store after D helped her conceal it under a sweatshirt she was wearing. Both parties were stopped. The judge found that D intended to deprive Lamont's of their property. D claims that the information under which he was charged was defective in that it did not include the common law language of intent to permanently deprive.
