Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

The Prosecutrix alleged she was raped on August 7, 1980. D was charged with aggravated felonious assault and defended himself by denying the charges. A deposition was taken of the Prosecutrix, and she refused to answer a series of questions regarding her sexual relations with her former husbands and any extramarital relations. The Prosecutrix refused to answer on advice of the District Attorney and D filed a motion to compel answers. The trial judge granted the motion and reserved the issue of admissibility of any of the evidence discovered. The DA moved for an interlocutory appeal. The Prosecutrix hired private counsel and pursued this appeal.
