Facts
Savage (D) took a three-gallon can of gasoline from a car, drove a mile away, and poured the gas into his tank. D then threw the can away and never informed the owner. D claimed that he left the empty can with a companion and instructed him to return a like amount of gasoline. The companion denied this.
