Facts
Wilson (D) confronted his estranged wife at work and threatened her. D then went to get the loaded shotgun from his car. D's estranged wife locked herself safely behind some doors and D could not get to her. D was convicted of attempted assault with a dangerous weapon. D appealed: there is no such crime as an attempt of an attempted battery.
