State v. Zimmer
198 Kan. 479, 426 P.2d 267 (1967)
Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Zimmer (D) kidnapped and murdered a child. The place of the murder was never established at trial. The abduction was committed in Shawnee County. The victim's body was found in Pottawatomie County. D was tried and convicted of felony murder. D appealed. D contends that the prosecution had never established Shawnee as the proper place to hold the trial and that there was no evidence that the killing occurred there. D also contends that the prosecution did not prove that the victim was confined against her will. A state law provided that kidnapping may be tried in any county into or through which the victim was brought and that a public offense committed partly in one county may be tried in either county.
