Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Wellington Service Corp. (D) drove a large truck over a public way. A city ordinance set the maximum weight requirement, which D exceeded. Pipes underneath this street later became uncoupled, causing Stimpson (P)'s basement to flood. The jury found for P. One of the questions on appeal was whether P could connect the flooding in his basement with D's violation of the statute.
