Facts
Bazeley (D) was the chief teller at a bank. D took a deposit from William Gilbert through his employee George Cock. D credited Gilbert’s account and put £100 in his pocket. D then used the monies to discharge a personal debt. The monies were never deposited in the bank drawer. D was charged with larceny.
