Facts
This is a case of collision on Lake Ontario. Ps were the owners of the schooner Cuba, and Ds the master and owners of the propeller Genesee Chief. The Cuba was on a voyage up the lake, The Genesee ran foul of her and damaged her so seriously that she shortly afterward sunk, with her cargo on board. Ps allege that the collision was occasioned by the carelessness and mismanagement of the officers and crew of the propeller, without any fault of the officers or crew of The Cuba. Ds deny that it was occasioned by the fault of the steamboat, and impute it to the carelessness with which the schooner was managed. The proceeding was in rem and in admiralty. The proceeding was in rem and in admiralty. It was instituted under the act of February 26, 1845, extending the jurisdiction of the district courts to certain cases upon the lakes and navigable waters connecting the same. Ps got the verdict and it was affirmed by the Circuit Court. Ds appealed. Ds in part challenged admiralty jurisdiction beyond tidal waters.
