Facts

Thornes (P) owned 1/2 the ship Sea Nymph. Deas (D) owned the other half. The vessel sailed from New York for North Carolina and in two conversations on the subject, D assured P that he would procure insurance. D did not do so, the ship was wrecked, and P sued D for nonfeasance. P got the verdict and D appealed.
