Facts

Cores (D) entered the U.S. through Philadelphia. D stayed after the time permitted on his visa. D willfully and knowingly remained in the United States in violation of Section 252(c) of the Immigration and Nationality Act. D was caught and charged for this crime in Connecticut. The district court dismissed the indictment because there was no proof that a crime had been committed in Connecticut. The charges against D were dismissed, and the U.S. appealed.
