Facts
Fuller operated a ranch of 1,280 acres with land of 12,027 acres leased from Arizona, and 31,461 acres held under Taylor Grazing Act permits from the federal government. The U.S condemned 920 acres of Fuller's land. The parties disagreed as to whether the jury might consider the value accruing to the fee lands as a rule of the permit lands under the Taylor Act. The government did not want that to happen, but the District Court adopted Fuller's position. The Court of Appeals in the Ninth Circuit affirmed.
