Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

D got into an argument and a neighbor called 911 to report that D, a convicted felon, had a gun. The police found a gun inside a roommate’s chest (furniture). P charged D with possessing a firearm as a felon. P moved to exclude the evidence as unreliable under Evidence Rule 702. A battle of the experts began. The district court appointed two experts of its own as well. One of these experts said that STRmix evidence is reliable in general and as applied to this case; the other said it is reliable in general but not as applied to this case. The court excluded the STRmix evidence as unreliable. P filed this interlocutory appeal.
