United States v. Oaxaca
569 F.2d 518 (9th Cir. 1978)
Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Two men wearing ski masks and carrying guns held up the Crocker National Bank. The robbers took $2,208 in currency from two tellers at gunpoint and placed the money in a brown paper bag. The serial numbers of six of the stolen bills had previously been recorded. Belman (D) and Oaxaca (D) were eventually arrested and indicted for one count of armed bank robbery. Oaxaca(D) chose to testify in his own behalf. P sought to impeach Oaxaca (D) by introducing evidence that he had two prior felony convictions. The judge denied D’s request to limit such questioning. P was allowed to establish that Oaxaca (D) had been convicted of burglary in 1967, and of bank robbery in 1972. P was convicted and appealed on this issue in part.
