This action was taken under 42 USC 6973 and 42 USC 300i on behalf of the EPA. The United States requested a preliminary injunction that required Ds to fund a diagnostic study of the threat to the water supply of Atlantic City from Price’s Landfill and to provide an alternate water supply to those whose private wells has been contaminated by substances leaking from that landfill. The injunction was denied, and P appealed; the district court abused its discretion in denying the preliminary injunction.
