Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
P claims that because she lost her job, she should be able to recover mental distress damages. P's theory is that she was entitled to job security and peace of mind that is associated with such security and that an employment contract providing for job security has a personal element, and the breach of such a contract should be expected to result in mental distress. The trial court dismissed her claims for mental distress and exemplary damages. P appealed.
