Facts

P was convicted of attempted rape, attempted sodomy, and attempted kidnapping of a thirteen-year-old girl. The trial court let into evidence a prior 1981 incident where P used searching for a German Shepherd and $20 to lure the girl to his trailer and forcibly raped and sodomized the 1981 victim. The court said the prior incident showed intent and state of mind and was not too remote for the current 1987 incident. P applied for habeas corpus and appealed its denial.
