Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Washington and Sunday Players, Inc. (Ps) sued Kellwood Company (D) for breach of a November 2003 license agreement. D argues that, as a matter of law, it had no marketing obligations to Ps because the License Agreement limited its marketing expenditures based on P's net sales, which were minimal. The court reduced the jury award to $1.00. Ps appealed.
