Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
P was the record title holder of land and filed a complaint for quiet title alleging that D claimed ownership of the same land by adverse possession. At trial, P presented proof of her deed and a plat, which set out the parcel and the right of way. D then moved to dismiss alleging that P had not proved the conditions for maintenance of a cause of action and a right to relief. That motion was denied. P was given the judgment. D appealed.
