Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Decedents were killed in an airplane crash. The evidence presented indicated that the crash occurred because the plane's carburetor iced up. P contends that the plane was defective in using a carburetor rather than fuel injection and in failing to provide a carburetor heat gauge. The jury found for P on the basis that the FAA's approval of the design was not a complete defense. D appealed.
