Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
P is a corporation organized under the laws of the State of Delaware. D is an individual resident in Redlands, California, United States of America. P owns both service marks and trademarks for WORLD WRESTLING FEDERATION. D registered the domain name for a term of two years from October 7, 1999. D has no affiliation with P. Three days after registering the domain name D contacted P by e-mail and notified complainant of the registration and stated that his primary purpose in registering the domain name was to sell, rent, or otherwise transfer it to P for a valuable consideration in excess of D's out-of-pocket expenses. By e-mail dated December 3, 1999, D contacted Ps representative and offered to sell the domain name for the sum of $1,000.00. D stated that cybersquatting cases 'typically accomplish very little and end up costing the companies thousands of dollars in legal fees, wasted time and energy.' D has not developed a Web site using the domain name at issue or made any other good faith use of the domain name. D has no connection whatsoever in P’s mark. P claims that D has no rights or interests in its mark and owning its domain name.
